Divorce (talaq, talaq, talaq)

In case you get married, if they don't get along, there is a possibility of divorce. Once married, if they do not get along, there is a possibility of divorce. Yes, it is allowed, but it is not encouraged. However, if the marriage no longer works and the divorce takes place, the woman is received back into the family. The families of Oman are very united. They are the basis of society.
Islam requires that spouses make the marriage contract permanent, so that the marriage is characterized by continuity, and the spouses remain together until death do them part. Marriage is called the solemn oath in Islam.
How is divorce pronounced and who pronounces it? In Islam there are two forms of divorce: The first is Talaq, pronounced 3 times by the husband. And the second is Khuf, the separation desired by the wife by the dissolution of the marriage by the judge.
I will make a brief presentation of the two forms of divorce because there is a lot to talk about here. I will talk about divorce in Islam another time, for us marriage and wedding traditions in Oman are important.
The divorce pronounced by the husband talaq, is known as repudiation (this being only a right of the husband; only the husband can repudiate his wife, not the other way around). The marriage is also dissolved in the event of the death of one of the spouses.
In the second form of divorce when the wife wants to divorce her husband. In case, if she discovers that her husband is a defect that cannot be cured or his healing is long lasting. Or if the husband has been absent for more than a year, in which case it is written to the husband either to come, or to take his wife where he is, or to separate from her.
If the husband does not want a divorce, the wife can still file for divorce in court because he cannot support her properly.
Although Islam accepts divorce, it still insists that husbands not rush to divorce, which is why it states that in certain situations, the husband cannot file for divorce.
In these situations they are: when the wife is in the menstrual period, when the sexual desire could not materialize between the two spouses, also the husband must have two witnesses when pronouncing the divorce.
Repudiation can be generated by the spouse only if the marriage has been consummated and results in the separation of the spouses during the so-called period of continence. It takes three months to see a possible pregnancy. If the woman is pregnant, a reconciliation is attempted.
The husband may remarry his wife even after a second divorce, however, if he divorced her for the third time, he may not remarry her, unless she marries. with another man, who later actually divorces.
Another question a good friend asked me: After divorce, who do the children stay with? In case of divorce, the children remain with the mother until adulthood. In case the mother remarries then the children go to the father. On this subject I want to talk more to be understood by my readers. In this sense, the Qur'an applies to the situation of very young children. Babies should be breastfed by their mothers for up to two years. For older children, traditional Islamic jurisprudence has established the following rules: Girls are in their mother's care until they reach puberty or remarry.
Boys remain with their mother until the age of seven or until they reach puberty. Here depending on how both parties understand each other.
In both cases, the legal guardian is their father. In practice, a woman usually returns to her parents after a divorce without her children; this will make it easier for her to remarry.

 What do women and men do after divorce? After the divorce, the woman returns to her parents, just as the man returns to his family until he marries again.
After signing the contract and making both parties aware of their requirements. Every Muslim strictly observes the Qur'an and teaches his younger generation to respect them and to follow them with holiness.
But what do women who have no parents or live far from them do? They certainly have a guardian (an uncle, a brother or a brother-in-law who has promised to take care of her and take care of her until she remarries) who can take care of her. But if in case they live far from family, then
they live alone, taking care of them.
